Terms and Conditions for Participating Therapists

Thank you for your interest in The Loveland Foundation’s Therapy Fund program (the “Program”). This document, the Terms and Conditions for Participating Therapists (the “Therapist Terms and Conditions”), sets forth the terms and conditions of your access to the Loveland Therapy Portal (the “Portal”), which allows eligible therapists to directly submit vouchers for payment to The Loveland Foundation.

Upon your acceptance of these Therapist Terms and Conditions, The Loveland Foundation (hereinafter, “we,” “us” or “our”) will grant you (hereinafter, “you” or “the Participating Therapist”) access to the Portal in order to be able to submit vouchers for qualifying therapy services for payment, in accordance with the instructions set forth herein and in the Participant Overview Document, as the same may be updated from time to time (the “Participant Overview”). In the event of any conflict with the Participant Overview, these Therapist Terms and Conditions shall govern.

Please note this is a legal document and, by accepting these Therapist Terms and Conditions, you are entering into a legally-binding and enforceable agreement.

Use of the Portal

In order to directly submit vouchers for payment using the Loveland Therapy Portal (the “Portal”), you will be required to create a profile on the Portal. Additional terms and conditions will apply to your use of the Portal (the “Terms and Conditions for Loveland Portal”). You agree to comply with and be bound by the Terms and Conditions for Loveland Portal.

Qualifying Services You understand that you may only submit vouchers for payment if you are a Qualified Provider (as defined below) and you have provided qualifying mental health therapy services (“Qualifying Services”) to a current Loveland Therapy Fund participant (a “Participant”).

To constitute “Qualifying Services”, mental health therapy services must meet all of the following criteria:

  • The services must be provided by a licensed provider of mental health therapy services or by an individual under the supervision of a licensed provider of mental health services in accordance with relevant licensing requirements (a “Qualified Provider”); and
  • Services must have been provided in the United States; and
  • Services must have been completed while the Participant was actively enrolled in the Program.

Vouchers and Voucher Submission

The Loveland Foundation provides vouchers to Participants to be used towards the cost of Qualifying Services. Current information on the details of such vouchers (including the number and dollar value of vouchers and limitations on voucher use and redemption) and instructions on submitting vouchers for payment via the Portal can be found in the Participant Overview.

Vouchers must be submitted through the Portal within 30 days of the applicable Qualifying Service. If you fail to timely submit vouchers for payment, including as a result of access or verification issues, or to comply with any of the other Program terms, The Loveland Foundation is not responsible for issuing payment, even where a Qualifying Service has been completed. The Loveland Foundation cannot be and is not responsible for creating manual workarounds to submit invoices outside of the Portal.

The Loveland Foundation currently processes voucher payment requests on a bi-monthly schedule. Payments for vouchers that have been properly submitted in accordance with these requirements and other Program terms are generally made within three weeks of submission; however, The Loveland Foundation does not guarantee that all payments will be made within such timeframe.

Responsibility for Costs of Services

You understand and agree that Participants, and not The Loveland Foundation, remain primarily responsible for the costs of all therapy services provided by you to such Participants. This responsibility includes, but is not limited to, responsibility for the full costs of any services that are not Qualifying Services; the costs of any Qualifying Services that exceed the amount of a voucher; and/or the costs of any Qualifying Services when vouchers are not properly submitted in accordance with The Loveland Foundation’s requirements for voucher submission.

No Duplication of Payment

You may not use, and agree that you will not use, any vouchers to request payment for any expenses that have been paid (or that will be paid) to you by the Participant or any other third party. For example, you agree that you will not submit vouchers to request payment for therapy costs that have been paid or that will be paid by a Participant’s insurance provider.

Our Rights

The Loveland Foundation reserves the right to:
  • Reject or deny payment for any voucher that is not submitted in accordance with the instructions provided by The Loveland Foundation;
  • Reject or deny payment for any voucher if The Loveland Foundation, in its sole discretion, suspects fraud or abuse by the Participating Therapist;
  • Terminate your access to the Portal if you do not comply with these Therapist Terms and Conditions or for any other reason, in The Loveland Foundation’s sole discretion;
  • Change the type, number, dollar value, and/or submission process for vouchers issued as part of the Program; and/or
  • Discontinue the Program in the event of a loss of funding or for any other reason.

We will make reasonable efforts to notify you in the event that The Loveland Foundation exercises any of the foregoing rights. In the event that your access to the Portal is terminated, Participants you serve may continue to utilize their remaining vouchers for Qualifying Services you provide by utilizing the self-pay/reimbursement option described in the Participant Overview. However, you will no longer be eligible to submit vouchers directly to The Loveland Foundation for payment via the Portal or otherwise.

Release of Liability and Waiver of Claims; Disclaimer of Liability

By agreeing to these Therapist Terms and Conditions and in consideration of your access to the Portal, you agree to waive and release The Loveland Foundation and its directors, officers, employees, volunteers, consultants, contractors, and agents (together, the “Released Parties”) from any and all liability, claims, costs and damages of any kind which you, your next of kin, or your legal representatives may have or which may later accrue, resulting or arising directly or indirectly from your participation in the Program, including those relating to the submission and processing of vouchers.

In addition, you agree that, in no event will The Loveland Foundation be liable for any (a) special, incidental, exemplary, or indirect damages, or any economic consequential damages, or (b) lost profits, business, value, revenue, or goodwill.

You understand and agree that the foregoing waivers and releases include all claims regardless of the cause, even those caused by the negligence of the Released Parties.

Survival

These Therapist Terms and Conditions will apply for as long as you are a Participating Therapist with access to the Portal and will continue to apply with respect to your access to the Portal and any voucher payment requests made using the Portal after such access has ended.

Governing Law, Resolution of Disputes

These Therapist Terms and Conditions and any disputes relating to your access to the Portal and submission of vouchers will be governed by the laws of the State of New York, without reference to its choice-of-law principles.

You agree that the only proper jurisdiction and venue for any dispute with The Loveland Foundation, or in any way relating to your access to the Portal and submission of vouchers, is in the state or federal courts located in New York, New York. You further agree and consent to the exercise of personal jurisdiction in these courts in connection with any dispute.

Changes to Terms and Conditions

The Loveland Foundation may change these Therapist Terms and Conditions at any time, and such changes will be posted on the Portal. Any modifications will be effective immediately upon such posting. You can determine when these Therapist Terms and Conditions were last revised by referring to the date listed at the top of these Therapist Terms and Conditions. We encourage you to read the Therapist Terms and Conditions periodically.

You may terminate your access to the Portal at any time by providing written notice to info@thelovelandfoundation.org. By continuing to access the Portal after we make changes to these Therapist Terms and Conditions, you are consenting to such changes.
